Filing tax on time, along with Form 67 when claiming foreign tax credit, keep penalties and interest from tacking up unnecessarily.

What are the general tax obligations for an Indian citizen working overseas?

Obligations depend on residential status, not just citizenship. A non-resident is taxed only on income sourced from India, things like rental income or interest from Indian accounts, while overseas salary sits outside India's tax scope entirely. Residents, or those caught under the deemed residency provisions aimed at high earners paying no tax elsewhere, may still need to declare and pay tax on global income. Residential status is worth reassessing each year rather than treating it as fixed.

How does the double taxation avoidance agreement (DTAA) process work for Indian expats?

When income gets taxed twice, DTAA tie-breaker provisions decide which country gets primary taxing rights. This is usually based on where the permanent home or centre of vital interests sits. A Foreign Tax Credit allows tax already paid abroad to be set off against Indian liability, as long as it's supported by a valid Tax Residency Certificate and Form 10F (Form 41 as per income tax rules 2026). The credit only comes through if Form 67 (Form 44 as per Income tax rules 2026) is filed before the return deadline, so skipping that step forfeits the benefit even when everything else checks out.

How is foreign income taxed for non-residents in India?

Non-residents pay Indian tax only on income that arises or is received within India. Foreign salary, overseas investment income and earnings from work done abroad all stay outside this net. What remains taxable includes Indian rental income, interest from Indian bank accounts, and capital gains on Indian assets. Anything genuinely foreign-sourced, with no link back to India, doesn't enter the calculation at all, irrespective of citizenship.
